Who Sets the Speed Limit on a Private Road?

You do. Section 128 of the Highway Traffic Act, R.S.O. 1990, c. H.8 sets speed limits for highways, and a private road, condominium laneway or commercial parking lot is generally not a highway under that definition. That means the province does not assign a speed limit to your property. The owner or property manager chooses the value and posts it. No regulation forces a private owner to post a specific number; the value on this sign is your decision for your site.

Posting a clear, visible limit is still one of the most common risk-control measures on private property. Occupiers in Ontario owe a duty under the Occupiers' Liability Act, R.S.O. 1990, c. O.2 to keep premises reasonably safe for people on them, and a posted speed limit is a practical, visible part of showing that care on roads you control. Typical owner-posted values are 10, 15, 20, 30 or 40 km/h depending on sight lines, pedestrian traffic and how the road is used.

Placement Guide

Post a sign at each entrance to the private road so the limit is visible before a driver builds speed, then repeat the sign roughly every 150–300 metres on longer roads and after major intersections or curves. Mount the panel so the bottom edge sits about 2 metres above grade where pedestrians pass beneath it, and keep the face square to approaching traffic. On gravel or cottage-association roads, a sign at the gate plus one at each fork covers most layouts.

Yes. Because the limit on a private road is owner-posted, you enter the exact km/h value you want at checkout. Most properties choose between 10 and 40 km/h.

Is a posted limit on a private road enforced by police?
Generally the Highway Traffic Act speed limit rules apply to highways rather than private property, so enforcement on your road is primarily a matter for the owner. Through site rules, leases or condo bylaws. Some municipalities can extend certain rules to private property by agreement; check with your municipality if that matters for your site.

Which material should I pick?
